Man Reprieved from 60-Year Sentence Arrested Again




Herbert Smith, 24, of Broward County, Florida was arrested Monday on charges of burglary. Smith previously had a 60-year sentence for a string of robberies commuted following public outcry over the harshness of the sentence, reports ABC Local 10 News.

Judge Matthew Destry, who passed down then later commuted the sentence, eventually lost his job over the affair. He resigned in mid-October following formal charges by the Judicial Qualifications Commission stemming from his handling of the matter.

Smith allegedly stole $30,000 in jewelry from a home in Parkland, Florida in September along with Deshaun Robinson, 18, who was arrested for the crime Oct. 28. Smith was charged with burglary, probation violation and grand theft.
